California PROP 65 Prop 65 is a consumer "right to know law." Unless exempted, a business must not expose an individual to a listed chemical (Prop 65 warning) without "clear and reasonable" notice of the chemical or discharge the chemical into a drinking water source.

The list of hazardous chemicals is long and updated frequently. Regardless of whether the product is already widely available or is new to the market, companies should verify that the product meets legal requirements and ensure access to the California market. Violations of the requirements may result in a civil penalty of up to $2,500 per day per violation.
